1. About these Terms

These Terms govern the purchase and use of the STAND DOWN digital audio programme (the “Programme”) and associated educational resources, including visualisations, videos and Ask CHUCK. The provisions about educational use, CHUCK, acceptable use and liability also apply when you use CHUCK without buying the Programme. These Terms don’t, by themselves, establish that you’ve given any separate consent or acknowledgement required by law.

Contracting operator: The Institute of Applied Psychophysiology, trading as STAND DOWN Recovery, based in United Kingdom (the “Operator”, “we”, “us” or “our”). Contact: comms@instituteofappliedpsychophysiology.com.

2. Who may purchase

The purchaser must be at least 18 years old and legally able to enter into a contract. If the Programme is made available to a person under 18, the adult purchaser remains responsible for deciding whether it’s suitable, supervising access and complying with these Terms.

You must provide accurate account and payment information. Your account is personal to you and must not be transferred or shared.

3. What you’re buying

You’re buying time-limited, personal access to a structured digital audio programme. You’re not buying ownership of the recordings, scripts, methods, website, software or other intellectual property.

Subject to payment and these Terms, we grant you a limited, non-exclusive, non-transferable and revocable licence to stream the Programme for your own personal, non-commercial use during the access period stated at checkout.

4. Immediate digital delivery

The Programme is digital content. Delivery begins when we make programme access available to your account, whether or not you immediately listen to every recording. Entry into the Programme includes signing in to the programme area, registering a device, opening the library, or opening or streaming any recording.

Access may be made available shortly after payment. Checkout doesn’t ask you to make a separate express request for supply during a statutory cancellation period or to acknowledge losing a statutory cancellation right. Starting access doesn’t, by itself, mean you’ve waived a cancellation right. Any cancellation rights available under applicable law remain in place.

5. Refund policy

Outside any statutory cancellation period or other mandatory rights, we don’t offer discretionary change-of-mind refunds once digital supply has begun.

This commercial policy includes requests based on not completing the Programme, deciding not to continue, personal preference or failing to use the available access. It doesn’t remove a cancellation right that applies to your purchase under the law.

Nothing in these Terms excludes a refund, repair, replacement, price reduction or other remedy where applicable law says that right can’t be excluded—for example, where digital content is faulty, materially not as described, or hasn’t been supplied with legally required care and skill. If you believe a mandatory legal remedy applies, contact us with your order details and a clear description of the problem.

6. Your payment doesn’t transfer our intellectual property

The Programme contains the Operator’s and presenter’s original voice recordings, guidance, scripts, sequencing, concepts, branding and other protected material. All rights not expressly granted to you remain with their respective owners.

You must not copy, record, download except through an authorised feature, transcribe, reproduce, republish, sell, lend, share, broadcast, distribute, adapt, scrape or make the Programme available to another person. You must not share account credentials or bypass access, streaming, device or security controls.

If a payment is reversed, charged back or refunded, your licence and access end immediately. You must stop using the Programme and delete any authorised offline copy. Continued use, copying or sharing after the licence ends is unauthorised and may infringe intellectual property rights.

7. Device and access controls

Access may be limited to one registered device and one active stream. These controls protect the recordings and keep each licence personal. You’re responsible for the security of your account, device and sign-in details.

We may suspend access while investigating suspected sharing, copying, payment reversal, fraud, security abuse or another material breach. We may terminate access for a confirmed material breach, subject to any rights that can’t legally be excluded.

8. Educational purpose, voluntary participation and Ask CHUCK

Educational content, not clinical care. STAND DOWN is an educational programme. Its recordings, visualisations, videos and CHUCK conversations provide general information and explain the Programme’s framework. They don’t provide a diagnosis, medical treatment, psychotherapy, prescribing or advice tailored by a regulated clinician. Using them doesn’t establish a clinician–patient relationship with the Operator, its team, contributors or CHUCK.

Voluntary participation. You choose whether to purchase, participate and continue. You can pause or stop using any part of the Programme or CHUCK at any time, and you’re not required to complete an activity or follow a suggestion. Stopping doesn’t itself create an additional refund right; your cancellation and other mandatory rights in sections 4 and 5 remain unchanged. Voluntary participation isn’t a waiver of any claim or right that the law protects.

No guaranteed outcome. Individual experiences vary. We don’t guarantee recovery, removal of a disorder, symptom improvement, a particular result or a timescale. Examples, explanations and personal experiences aren’t promises of what you’ll experience. This doesn’t remove your right to receive content and services as described or any other binding commitment we’ve made under applicable law.

Your decisions and professional advice. You’re responsible for deciding how to apply general information to your circumstances, including decisions about relationships, work and daily life. Don’t rely on the Programme or CHUCK as your sole basis for a health, safety, legal or financial decision. Obtain appropriate qualified advice when needed. Don’t delay seeking healthcare, disregard clinical advice, or start, stop or change prescribed treatment or medication because of programme content or a CHUCK response; discuss treatment changes with your qualified clinician.

CHUCK’s limitations. CHUCK is an AI-powered personal guide, not a person or clinician. His responses can be inaccurate, incomplete, inappropriate or unsuitable for your circumstances, even when they sound confident or reassuring. A friendly style isn’t verification of accuracy or a safety assessment. Check important information independently and don’t treat a response as a diagnosis or professional recommendation. CHUCK isn’t an emergency service. If you or someone else is in immediate danger, contact local emergency services rather than relying on CHUCK.

Safe participation. Use the content in a safe setting. Don’t use relaxation or visualisation recordings while driving, operating machinery or doing anything that requires your full attention. Pause or stop if an activity causes distress or discomfort, and seek appropriate professional support if it persists or you’re concerned. These responsibilities don’t reduce our own legal duties.

9. Availability and technical requirements

You’re responsible for a compatible device, a supported browser, a reliable internet connection and any data charges. We may maintain, secure or update the service and will use reasonable care to keep paid access available during the stated access period.

We don’t promise uninterrupted or error-free availability. If a problem on our side materially prevents access, contact us so that we can investigate and, where appropriate, restore access or provide a remedy required by law.

10. Liability

We’re responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. Subject to the protections below, we’re not responsible for losses that weren’t reasonably foreseeable when the contract was formed, or business losses such as lost profits or business opportunities arising from use of a personal, non-commercial programme.

Actions you take. To the extent permitted by law, we’re not responsible for loss or damage caused solely by your independent decisions, deliberate misuse, unlawful conduct or use contrary to clear safety instructions, where our breach, negligence or other legally actionable conduct hasn’t caused or contributed to that loss. This isn’t a blanket exclusion for actions taken after reading or listening to our content, and it doesn’t transfer responsibility for our own wrongdoing to you.

Limited indemnity for third-party claims. To the extent lawful and fair under the law applicable to you, you’ll reimburse the Operator only for reasonable, evidenced losses, damages and reasonable legal costs arising directly from a third-party claim caused by your fraud, deliberate unlawful misuse of the service, or deliberate infringement of another person’s rights through material you submit or distribute. Any reimbursement must be proportionate to your responsibility and established by a final court decision or a settlement you’ve agreed to in writing. It doesn’t include losses attributable to our breach, negligence or other wrongdoing, or losses we could reasonably have avoided.

We’ll notify you promptly of such a claim, provide reasonable details and an opportunity to respond, and take reasonable steps to minimise loss. We won’t agree to a settlement imposing an obligation on you without your written agreement. This indemnity doesn’t apply to ordinary good-faith use, asking CHUCK questions, experiencing symptoms, not achieving a desired outcome, making a complaint or exercising a legal right. It doesn’t authorise us to charge your payment method automatically.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability or consumer right that the law doesn’t permit us to limit or exclude. Your mandatory rights concerning digital content, services, cancellation, refunds and remedies remain in place. No disclaimer or indemnity in these Terms overrides those protections. If a provision is unlawful or unenforceable, it won’t apply to that extent; the remaining lawful provisions continue.

11. Changes, governing law and contact

We may update these Terms for future purchases. The version accepted when you purchase will govern that purchase unless a change is required by law or benefits you without reducing your rights.

If you’re a consumer resident in the United Kingdom, these Terms and any dispute or claim are governed by the law of the part of the United Kingdom where you ordinarily live: England and Wales, Scotland, or Northern Ireland, as applicable. You may bring proceedings in the courts of that part of the United Kingdom. If you live elsewhere, any mandatory protections and rights to bring proceedings available to you under the law that applies to you are preserved. Nothing in these Terms creates an exclusive jurisdiction or limits a mandatory consumer right.

Questions, access problems and claims for a mandatory legal remedy should be sent to comms@instituteofappliedpsychophysiology.com.
